The ‘Court-Fees (Delhi Amendment) Act, 2010’ [Act
01 of 2011 notified on 11 Feb, 2011], amended ‘Court Fees Act, 1870’ [Act 07 of
1870] in its application to National Capital Territory of Delhi and introduced section
16A in the Court Fee Act.
As per section 16A, if a suit is dismissed as
settled out of court before evidence is lead or compromised ending into
compromise decree or appeal is disposed off before hearing, half of the amount
of all fees paid (court fee etc.) shall have to be refunded by Court to the
party who paid such fees.
