Sending offensive messages may land you in jail


Information Technology Act, 2000 was amended by the Govt. by Information Technology (Amendment) Act, 2008, by which Section 66A was inserted.

As per Section 66A, a Person shall be liable to 3 years imprisonment or fine, if he sends to anyone, by means of computer resource [Computer etc.] or any communication device [Mobile etc.]:

(i)      any information that is grossly offensive or has menacing character; or

(ii)    any information with the purpose of causing annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, enmity, hatred, or ill will,

(iii)   any electronic mail or electronic mail message for causing annoyance or inconvenience or to deceive or to mislead the addressee or recipient about the origin of such messages.
